statutes, regulations, and ordinances; provided, <br />however, that the contractor fails to provide <br />collection service to a residential dwelling unit <br />because of any of the above conditions, then the <br />Contractor shall have five (5) days (excluding <br />Saturdays, Sundays, and holidays) to provide such <br />service, and in the event of a continuing failure <br />beyond said period, the Contractor shall not be <br />entitled to payment for any residential dwelling <br />unit not so serviced. Provided further, however, <br />that the Contractor shall not be deemed to be in <br />default of this Contract where its inability to <br />perform results from labor disputes or disposal <br />facility closures; however, the Contractor shall not <br />be entitled to payment for any day in which its <br />trucks do not make collections due to the above two <br />circumstances. <br />11. Surety Bond. A performance bond guaranteeing the faithful <br />performance of this contract by each individual contractor <br />shall be provided to the City of Little Canada. This <br />contract is subject to termination by the City any time <br />said financial guaranty does not remain in full force. <br />12. Insurance. During the entire period of the contract, the <br />Contractor shall maintain, at their expense, and file with <br />the City, policies or certificates of Worker's <br />Compensation, Auto Liability, and General Liability <br />insurance. Minimum Liability Insurance coverage <br />requirements are $300,000.00 bodily injury per person <br />$500,000.00 aggregate per occurrence, and $100,000.00 <br />property damage. All liability policies evidencing <br />insurance required by this paragraph shall name City and <br />the Contractor as named insured. Such policies shall be <br />in the form and context satisfactory with the City <br />Attorney and shall be filed with the City Administrator. <br />A certificate showing that the Contractor has in effect <br />the aforesaid insurance covering both the City and the <br />Contractor. <br />13. Performance of Contract. <br />A. Supply Necessary Items. The Contractor shall supply <br />all labor, material, and equipment necessary for the <br />carrying out of this Contract. <br />B. No Claims. The Contractor agrees to pay all persons <br />doing work or furnishing skill, tools, machinery, or <br />materials or insurance premiums or equipment or <br />supplies and all just claims for such work, <br />material, equipment insurance, and supplies in and <br />about the performance of this Contract. <br />11 <br />Page 83 <br />
