Hanson <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: November 17, 1995 <br />RE: Valley Paving Request for Payment <br />Attached is a request for payment from Valley Paving. As you <br />will note, this request was dated September 25, 1995. Pursuant <br />to contract provisions, this request should have been paid within <br />30 days of receipt. Therefore, I am presenting it to you at this <br />time subject to recommendation from the engineers regarding the <br />imposition of liquidated damages (payment reduction) and the <br />application of accrued interest (increase to pay request). <br />The exact amount of deductions /additions is still being finalized <br />by the City Engineer. The City Attorney and I are also reviewing <br />the matter to insure conformance with contractual requirements. <br />The amount of liquidated damages to be withheld could be <br />substantial. The contractor is aware that we are evaluating this <br />issue and has indicated his displeasure with that fact. <br />We will provide further information at Wednesday's meeting <br />regarding specific actions we need to take to process this pay <br />request. <br />Page 93 <br />
