undertaken consist of acquisition, relocation, and demolition <br />actions required for construction of a new shopping center, <br />motel, restaurants, movie theater, medical clinic, bank, and <br />senior housing together with related appurtenances as well as <br />public improvements to serve the proposed development including <br />the reconstruction of Little Canada Road and upgrades of other <br />public improvements necessary to serve the project. <br />2. Developer and City Acknowledgment as to the Need for <br />Timely Submittals and Responses: The parties hereto acknowledge <br />that timely submittals and responses thereto are crucial to the <br />evaluation of the proposed project, and agree that failure to <br />provide information as detailed within this Agreement in a timely <br />manner and on the dates specified herein shall constitute a <br />breach of this Agreement. <br />3. Development Review Process. Developer hereby <br />represents to City that it intends to commence construction on <br />the project by May 15, 1995. To achieve that date, Developer <br />agrees to meet with the City's Planner, Stephen Grittman, to <br />establish a schedule for submission of documentation necessary <br />for any and all zoning and subdivision approvals needed by the <br />project. Said schedule is to be submitted by December 30, 1994, <br />in a form and manner that is acceptable to the City's planner. <br />Subject to approval by the City's Planner, Developer shall submit <br />a letter to the City indicating agreement with the schedule and <br />their commitment to comply with all deadlines contained therein. <br />Failure to meet the dates set forth in this schedule will <br />Page 44 <br />
