Center, Developer agrees to work with City to explore any <br />alternative acquisition method which may meet their mutual <br />objectives while resulting in less cost to the project. <br />6. Use of Eminent Domain Powers. For any parcels <br />Developer is unable to obtain an agreement to purchase through a <br />reasonable negotiation process, City hereby indicates its <br />willingness to utilize the powers of eminent domain as provided <br />for in Minnesota Statutes after Developer supplies appropriate <br />documentation evidencing their efforts in the negotiation process <br />and detailing why condemnation is necessary. <br />Developer understands City will not use its powers of <br />eminent domain on owner - occupied, single family residential <br />property. Developer further acknowledges that City may also <br />choose not to acquire other properties on behalf of the proposed <br />development when the City feels eminent domain would not be in <br />its best interests and City will incur no liability to Developer <br />or others for failure to exercise its power of eminent domain. <br />7. Relocation of Displaced Tenants /Owners. Developer will <br />prepare a relocation plan using the services of a qualified <br />relocation specialist to be approved by the City. Said plan <br />shall provide a listing of tenants and owners who are to be <br />relocated, a time -line for relocation, and relocation fees to be <br />paid, if any. Developer also will comply with any applicable <br />provision of the Uniform Acquisition and Relocation Act relative <br />to this process. <br />The relocation specialist shall be recommended for <br />Page 46 <br />
