<br />This letter is in regard to the dispute between Valley Paving and the City concerning the
<br />withholding of payment for defective work, damage to owner and unsatisfactory prosecution of
<br />the work. Disagreements between the City and Contractor are by Condjtions of' the Contract -
<br />Article 7.10 to be referred to the Engineer for a written opinion. This letter is to serve that
<br />purpose.
<br />RESOLUTION OF PARTIAL PAYMENT
<br />The City and contractor disagree about the withholding of payment for defective work and
<br />liquidated damages. To resolve this, three separate issues must be addressed. They are:
<br />1. defective work issues,
<br />2. delayed completion and Liquidated damages, and
<br />3. payment of interest on delayed payment.
<br />Having reviewed these issues, it is our opinion that payment should be released in accordance with
<br />the following calculation.
