(9) Provide by November 20, 1995 evidence of lease agreements <br />covering eighty seventy percent (4-9 70 %) of the facility, <br />with specific agreements for a grocery store, drug store and <br />bingo hall. The thre&i 3d -drops to scvcnty perccnt (70- %) if <br />Bu get -Pe <br />(10) Provide by October 13, 1995 a summary of the status of <br />existing building tenants (i.e. -part of facility, not <br />interested or other). <br />(11) Improve and maintain parcels #06- 29 -22 -23 -0011 and #06 -29- <br />22 -23 -0012 (formerly Burger King and Pizza Hut) by replacing <br />fence, grading site, installing and maintaining green areas <br />as required by City ordinances, and maintaining with a dust - <br />free surface to accommodate parking. <br />(12) Dedicate easements and transfer ownership in utility mains <br />on property which serve a public purpose. Prior to <br />transfer, sewer main shall be televised and inspected and <br />water main shall be pressure tested. Necessary corrections <br />identified by this process shall be made by the Developer <br />prior to transfer. <br />(13) Cooperate with City regarding re- alignment of Market Place <br />Drive (County Road C -2) and Middle Street in a manner <br />consistent with Redevelopment Plans for the area. Developer <br />will dedicate necessary easements at no cost to the City for <br />public right -of -way for those roads which are located upon <br />Developer's property with the understanding that a mutually <br />agreeable plan for parking and traffic flow will proceed the <br />dedication of right -of -way. Developer further understands <br />that assessments for improvements may result from this <br />transaction. <br />(14) Provide renderings as described in City Action Item #3. <br />(15) Enter into a development agreement with City which more <br />clearly delineates all terms and conditions of this <br />transaction. Said agreement shall be drafted by Briggs and <br />Morgan, <br />(16) Provide personal guarantees, assignment of loans, and a <br />mortgage to secure the loan amount. <br />Timing <br />Both parties will make best efforts to undertake the tasks <br />described herein by November 39 20 , 1995. <br />-4- <br />
