Hanson <br />At the last Council meeting, I was instructed to meet with <br />Mr. and Mrs. Morelan to discuss the potential of requiring the <br />needed land to accommodate a 35 foot radius cul -de -sac on their <br />property which could involve the exchange of right -of -way <br />resulting from the vacation of a portion of Jackson Street. As a <br />preface to this meeting, I had the City Planner put together some <br />diagrams indicating setback impacts. (copies attached) Drawing <br />lA indicates the situation as it presently exists should the <br />Morelan's decide to subdivide the northerly portion of their lot. <br />Option 1B shows the impacts the cul -de -sac would have on this <br />situation. As you will note, it effectively moves the house <br />approximately 27 feet to the south on the lot. Drawing #3 was <br />prepared under the criteria of moving the cul -de -sac as far west <br />as possible to minimize the impact to the Morelan lot. As you <br />will note, the cul -de -sac has now been moved entirely off the <br />Morelan property and still allows buildable lots for Mr. Tima. <br />This is due to the Planner's interpretation of the rear yard <br />setback being on the south property line rather than on the west <br />line. Adequate buildable area remains, but the Magnuson's <br />property is also impacted. <br />Staff has also done some additional research on the possibility <br />of vacating a portion of the Jackson Street right -of -way. Based <br />on a drawing in our files indicating that the water main is <br />almost in the center of the Jackson Street right -of -way, we may <br />only be able to vacate the east 7 feet. This issue would need to <br />be verified with the City Engineer. <br />In meeting with Mr. and Mrs. Morelan, they indicated a <br />willingness to work with the City, but were very concerned about <br />the impact the cul -de -sac would have on structure placement for <br />the new lot. We discussed the possibility of a variance which <br />would allow them to maintain a front yard setback consistent with <br />Drawing lA based on the fact that the City is creating the <br />condition generating the hardship.
