Finance No, THIRTY - FOURTH RIDER TO AGREEMENT THIS AGREEMENT, made this 10 °i day of December, 2013, by and between the BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL ( "Board "), and the CITY OF LITTLE CANADA, County of Ramsey, State of Minnesota, ( "City "), being the Thirty -Fourth Rider to that certain Agreement made by and between the Board and the City the 1311 day of July, 1966, and by this reference incorporated herein and made part hereof and with the same intent, purpose and effect as if said Agreement were set forth herein verbatim, WITNESSETH: WHEREAS, the Board is owner of a 190 foot wide easement right-of-way located in the SW quarter (SW 1/4) of the SW quarter (SW '/) of Section 5, Township 29 North, Range 22 West, in the city of Little Canada, Ramsey County, collectively the "Premises"; and WHEREAS, the City desires to enter upon certain portions of said Premises to install, operate, and maintain a retaining wall and to realign an existing hard surface trait; and WHEREAS, the Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board NOW, THEREFORE, BE IT AGREED, in consideration of the mutual promises and agreements of the parties hereto, that subject to all terms and conditions contained in said Agreement between the parties hereto made and entered into the 13°i day of July 1966, the Board hereby grants to the City permission to enter upon portions of said Premises and to there within V:,Engincerir,g.CL R ICA 12B0 A RD'•Agreementssit DG R'•1. iulcCanada 034_12-10-1 xiocx 1 2
