Represent and prosecute all criminal law matters within the City's jurisdiction that <br />are not the responsibility of the County Attorney, included but not limited to <br />attendance at arraignments as scheduled by the Ramsey County District Court, <br />scheduling and coordinating of officer appearances, reviewing all criminal cases <br />presented for purposes of prosecution, determine technical compliance with <br />criminal code and other state statutes, writing complaints, making recommendations <br />to the Court for alternatives to prosecution where appropriate, act as a resource to <br />the City's law enforcement agency in the development of criminal cases, and <br />provide training sessions for law enforcement staff as needed. <br />Timely pursuit of disposition of criminal cases in advance of actual Court cases to <br />avoid unnecessary officer court time. <br />3. Subject to the development of a policy for forfeitures to be approved by the City <br />Council, process and present forfeiture cases on behalf of the City's law <br />enforcement agency pursuant to said policy. <br />4, Provide an annual report to the City Council on prosecution activities conducted in <br />the name of the City. <br />2. Compensation. Kelly & Lemmons, P.A. will submit monthly billing statements for the <br />services it provides to Little Canada under this Agreement. Our fine tracks and bills its time, in <br />quarter -hour increments. We will send detailed billing statements which reflect the date, time <br />billed, person performing the work, description of the work performed, and the line item amount. <br />We will submit separate billing statements for civil services and prosecution services. Our <br />compensation for the above services will be as follows: <br />Civil Services <br />Generally, for work on civil matters, Kelly & Lemmons, P.A. will charge an hourly rate <br />of $120.00 per hour for work performed by attorneys, and a rate of $60.00 per hour for <br />work performed by law clerks or paralegals. Attendance by request at public meetings of <br />the City Council, Planning Commission or other bodies of the City shall be billed at a flat <br />rate of $325.00, regardless of the length of the meeting. Kelly & Lemmons agrees to treat <br />Council Workshops immediately preceding normal City Council meetings as a single <br />meeting for billing purposes. <br />Prosecution Services <br />(a) For work on prosecution matters, including civil property forfeitures under the <br />criminal codes, Kelly & Lemmons, P.A. will charge an hourly rate of $100.00 per <br />hour for work performed by attorneys, and a rate of $60.00 per hour for work <br />5 <br />
