Hanson <br />RE: Votes Required to Approve Variances to the Zoning Code <br />and Subdivision Code <br />As a result of the Council's discussion relating to the number of <br />votes required to approve Variances to the Zoning Code and <br />Subdivision Code, I am attaching the sections of the City's Code <br />which address this issue as well as the standards by which the <br />merits of variances are measured. Also attached are copies of <br />State Statutes relating to Board of Adjustments and Appeals, as <br />well as Zoning and Subdivision regulations. <br />I have researched the minutes relating to the Council's review <br />and adoption of both the Zoning and Subdivision Codes, and have <br />attached those minutes which reference the vote required for <br />variances to the Zoning Code. There was no specific discussion <br />about votes required for variances to the Subdivision Code. <br />(This review took place over 1979 and into early 1980.) <br />At the request of the Mayor, I looked at the minutes and <br />Planner's reports relative to the Gervais Shores Addition (Dianna <br />Lane), Leibel Addition (Twin Lake Blvd. area), and Thunder Bay <br />Estates Second Addition. There is no reference in the minutes or <br />the City Planner's reports relating to the number of votes <br />required to pass variances that were part of these plats. <br />Finally, I surveyed some surrounding cities to determine how they <br />address variances to their zoning and subdivision ordinances.
