MINUTES <br />PLANNING COMMISSION <br />APRIL 10, 2014 <br />CUP PERMIT - <br />53 SOUTH <br />OWASSO BLVD. - <br />VERIZON <br />WIRELESS <br />been vacant that has lost it legal non- conforming status. Duray indicated <br />that be is not in favor of the Rezoning. <br />Maleitzke indicated that she struggles with this issue and feels badly for <br />the Vang's. Maleitzke indicated, however, that the Commission must <br />follow the Code. She did question if there was a way that the City could <br />communicate with property owners, realtors, the County etc. to prevent a <br />similar situation in the future. The City Planner indicated that there was <br />no single repository for property information of this type, and that the City <br />would be the source for zoning information. <br />Fischer recommended denial of the request for Rezoning from Single - <br />Family Residential (R -1) to Medium Density Residential (R -2) to allow <br />for the use of the existing structure as a duplex, 29 Demont Street, owners <br />Kageh and Kaojia Vang, given that the rezoning would be spot zoning, the <br />property has been vacant for longer than one year, and the City Code <br />establishes a time limit that triggers the loss of legal non- conforming <br />status, as well as based on the recommendations of the City Planner as <br />outlined in his April 7, 2014 report. <br />Motion seconded by Duray. <br />Motion carried 5 — 0. <br />"fhe City Planner reviewed his April 4, 2014 report relative to the <br />application of Verizon Wireless for a Conditional Use Permit to allow the <br />construction of a monopole communication tower and cellular antenna <br />upon a 2.5 acre, City -owned site at 53 South Owasso Blvd. The Planner <br />noted that the tower is proposed at 140 feet height. In conjunction with <br />the tower, a 360 square foot equipment building would be constructed at <br />the base of the tower. The Planner noted that this use is allowed in the I -1 <br />District subject to compliance with a series of conditions outlined in the <br />Code. The Planner pointed out that one of those conditions is that there is <br />no availability of antenna co- locations on an existing tower in the area. <br />The applicants have done this analysis, and determined that the existing <br />tower on this same property is full, and co- location is not an option. The <br />Planner reported that in reviewing the submittals it appears that the <br />conditions are met; however, there will need to be final verification done <br />as part of the building permit process. Staff is recommending approval of <br />the CUP subject to compliance with the conditions outlined in the April 4, <br />2014 planning report. <br />Steve Wegman, representing Verizon Wireless, indicated that the <br />applicant did review the existing tower on the City's property and that co- <br />-6- <br />
