MINUTES <br />PLANNING COMMISSION <br />JUNE 12, 2014 <br />Duray indicated that he looked at the property and felt that some of the <br />outdoor storage items were stored in a haphazard manner. Duray asked if <br />the site could be better organized. Stockness reported that he felt that <br />given the type of business that occupied the site, it was difficult to better <br />organize the outdoor storage. <br />Fischer noted that the rezoning of this property was before the <br />Commission a couple of months ago and that the Commission understands <br />the proposal very thoroughly. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Murphy recommended approval of the Conditional Use Permit for outdoor <br />storage at 3065 Spruce Street, Stockness Property, subject to compliance <br />with the recommendation of the City Planner as outlined in his June 6, <br />2014 report. <br />Motion seconded by Schwalbach. <br />Motion carried 6 — 0. <br />SUP — The City Planner reported that Heather Lindberg, 2310 Stephani Court, <br />2310 has requested a Special Use Permit (SUP) for a home occupation to <br />STEPHANI operate a home office with one part-time employee. The Planner reviewed <br />COURT — the Code which allows for home occupations under two classifications: <br />LINDBERG one being a permitted home occupation by right and the other requiring a <br />Special Use Permit. The Planner indicated that examples of permitted <br />home occupations include home offices, piano lessons, and other similar <br />uses. Special home occupations have characteristics which may tend to <br />disrupt the residential character of a neighborhood. Examples of special <br />home occupations include barber and beauty services, photography studio, <br />group lessons, saw sharpening, small appliance and small engine repair <br />and the like. <br />The Planner indicated that the City's Home Occupation Ordinance is <br />intended to ensure two objectives. One is that residential neighborhoods <br />are not subjected to non-residential disruptions. The other is that business <br />operators conducting business in a commercial district are not subject to <br />unfair competition from those paying only residential taxes. The Planner <br />noted that the Horne Occupation Ordinance lays out several conditions <br />that apply to the special home occupation class. One of these conditions <br />requires a SUP if there is anyone other than the property owner working at <br />the home occupation.
