MINUTES <br />CITY COUNCIL <br />APRIL 25, 2007 <br />The Administrator then reviewed in detail the Code Enforcement Officer's <br />report dated Apri125, 2007 outlining the results of the Valor property <br />inspection which occurred on April 24, 2007 by the Deputy Fire Marshal, <br />Building Official, Electrical Inspector, and Code Enforcement Officer. <br />These included a detailed listing of building code violations, outdoor <br />storage issues, auto repair issues, and auto sales issues. The City <br />Administrator also presented pictures of the Valor property some of which <br />compared conditions as existed on Apri124, 2007 with dates previous. <br />The City Administrator indicated that at the Planning Commission <br />meeting, Mr. William Griffith, Larkin Hoffman, representing Valor <br />Enterprises, indicated that auto repair is a permitted business use in the <br />City. The Administrator indicated that while auto repair is a permitted, <br />licensed use, outdoor storage requires a Conditional Use Permit. The <br />Administrator noted that Mr. Griffith argued that the CUP's should be <br />issued with conditions to Valor Enterprises. The Administrator pointed <br />out that the City did do that in 1999 and 2000; however, Valor Enterprises <br />has never been in compliance with the conditions of the CUPS. <br />Mr. William Griffith, Larkin Hoffman, reported that he has 20 years <br />experience on both sides of the table in zoning issues. Griffith stated that <br />he is convinced that his client is accepting of what needs to be done to <br />regain his Conditional Use Permits and licenses. Griffith reported that his <br />client suffered a serious consequence last September when the City <br />revoked his CUP's and did not renew his licenses. This impacted Valor <br />Enterprises ability to conduct business on this property severely. Griffith <br />noted that his client has addressed numerous Code requirements to allow <br />the use and occupancy of his building. He did so with the understanding <br />that at the conclusion of the process he would have the reasonable use of <br />the property for automobile repair and sales. Griffith noted that there are <br />many similar properties, situated just like the Valor property, in Ryan <br />Industrial Park. <br />Griffith reported that he was not in a position to respond the code <br />enforcement history this evening, and will be prepared to defend his client <br />if need be. <br />Griffith indicated that the property has been set up for the repair, storage, <br />and sales of automobiles. Without the CUPs and licenses, there is no <br />reasonable use of the property. Griffith felt it was a matter of common <br />sense that an auto repair businesses needed to store vehicles outside. <br />Griffith felt that was a logical accessory use for the permitted use of auto <br />repair. Griffith also noted that Valor Enterprises is reducing the number <br />of vehicles on his property. <br />17 <br />
