Fra -Dor, Inc. <br />Aggregate Stockpiling and Recycling Interim Use Permit <br />Interim Use Agreement <br />Page 8of16 <br />Owner have discussed potential redevelopment scenarios, and agree on a goal of maximizing <br />building area and quality on the site, consistent with the comprehensive planning direction for <br />the area. The City agrees to cooperate with Owner in evaluating the potential for acquiring <br />nearby parcels along Ryan Drive, in evaluating the relocation of a portion of Ryan Drive, and in <br />evaluating tax increment financing for the area consistent with the requirements of state law. <br />The Owner agrees to cooperate in the above and in evaluating the combination of an adjacent <br />property occupied by an affiliated landscape supply business in any redevelopment plan. <br />21. As a condition of the interim use permit, Owner agrees to list the Property as "for <br />sale" no later than October 1, 2012. Owner is not required to install signage upon the property <br />advertising its availability, but must maintain a listing of the property as available for purchase <br />and redevelopment consistent with City Code, and solicit and respond to inquiries about the <br />property from potential purchasers. Owner shall provide City with a copy of the listing contract, <br />and provide information to the City Administrator regarding inquiries and offers made at least <br />every six months following the execution of a listing contract. Owner shall obtain an appraisal <br />of the real estate value prior to listing the property, and share that appraisal with the City when <br />complete. The City expects that Owner wilt accept any commercially reasonable offer that <br />equals or exceeds the appraised value of the property; if Owner feels the appraisal value is <br />obsolete, he should update or replace the appraisal and share the new data with the City. The <br />City shall maintain any such information provided under this paragraph as confidential trade <br />secret data under § 13.37 of the Minnesota Government Data Practices Act. <br />22. The requirement to list the Property for sale shall not prevent Owner from <br />committing to re- <br />develop the site itself or with a business partner, or to prevent a business entity <br />9 <br />
