The final site shall be graded smooth and shall consist of gravel or four inches of topsoil appropriately seeded. 26. Following termination of the use and restoration of the property, all activities upon the property shall be in complete confonnity with City regulations, including but not limited to all applicable City codes, zoning ordinances, and subdivision ordinances. Agreement to Reimburse Costs 27, Owner shall pay all costs incurred by the City in connection with the issuance and monitoring of this Permit and Agreement and implementation of the restoration, including but not limited to engineering and inspection, legal, and planning expenses incurred in connection with approval of the permit, the preparation of this Agreement, and all costs and expenses incurred by the City in monitoring and inspecting the operation and reclamation of the site. Reimbursement shall be made within thirty (30) days of Owner's receipt of a statement of amount due from the City. Financial Surety 28. As financial security, Operator shall furnish the City with a Letter of Credit, performance and payment bond or other security in a City -approved format in the amount of $225,000.00 as a guarantee of completion of property restoration, including the costs of crushing the remaining stockpiles of unprocessed material, compliance with this Agreement, compliance with the teens and conditions of approval of the Interim Use Permit and compliance with any future City resolution associated with the permit. The City's costs of collection against the security may also be claimed against the security for reimbursement. 11
