The final site shall be graded smooth and shall consist of gravel <br />or four inches of topsoil appropriately seeded. <br />26. Following termination of the use and restoration of the property, all activities upon <br />the property shall be in complete confonnity with City regulations, including but not limited to <br />all applicable City codes, zoning ordinances, and subdivision ordinances. <br />Agreement to Reimburse Costs <br />27, Owner shall pay all costs incurred by the City in connection with the issuance and <br />monitoring of this Permit and Agreement and implementation of the restoration, including but <br />not limited to engineering and inspection, legal, and planning expenses incurred in connection <br />with approval of the permit, the preparation of this Agreement, and all costs and expenses <br />incurred by the City in monitoring and inspecting the operation and reclamation of the site. <br />Reimbursement shall be made within thirty (30) days of Owner's receipt of a statement of <br />amount due from the City. <br />Financial Surety <br />28. As financial security, Operator shall furnish the City with a Letter of Credit, <br />performance and payment bond or other security in a City -approved format in the amount of <br />$225,000.00 as a guarantee of completion of property restoration, including the costs of crushing <br />the remaining stockpiles of unprocessed material, compliance with this Agreement, compliance <br />with the teens and conditions of approval of the Interim Use Permit and compliance with any <br />future City resolution associated with the permit. The City's costs of collection against the <br />security may also be claimed against the security for reimbursement. <br />11 <br />
