Hanson <br />Frank Frattalone will be present at Wednesday's workshop to review the status of the <br />interim use permit and discuss an extension. To aid in your review, staff has attached the <br />current draft of the agreement plus comments from Mr. Frattalone's attorney and a <br />response from the City Attorney. We have resolved most of these issues verbally, but we <br />will walk through them all for the Council's benefit at the workshop so we are all on the <br />same page. <br />I again want to emphasize that the delays in completing this agreement are on our end of <br />the equation. The Council had agreed on the key terms of the agreement, but the drafted <br />document did not fully represent the understanding we had reached. Therefore, I did not <br />present it to Mr. Frattalone for review and execution. A few months ago, Patrick Kelly <br />was able to resolve the drafting concern issue and we have been working to get the <br />agreement into final form. At Mr. Kelly's suggestion, we felt it best to treat the past five <br />years as the "defacto agreement" given Mr. Frattalone has been complying with its key <br />terms and conditions. We felt it was a more productive approach to move to the <br />extension rather that finalize a document that was about to expire. <br />cc: Frank Frattalone <br />1 <br />
