I had also sent Chad my suggested <br />changes that were not part of the documents you have been exchanging. <br />I'm attaching the re -draft with my changes. Here is a summary of what I feel is necessary beyond what has been <br />discussed to date: <br />• Listed City as a "Minnesota Municipal Corporation". <br />• Paragraph 2.a. — Eliminated "interest bearing account" reference. It isn't worth our time to track interest on this <br />amount given the low rates we are dealing with. <br />• Paragraph 3.b. — I have already provided you with copies of any soils information we have in our <br />possession. Plus, if you do more reports, we would want a copy. <br />• Paragraph 3.d.—Again, I have provided all environmental information we have in our possession and the related <br />tank release data. Again, if you commission new reports, we would want a copy. <br />• Paragraph 3.e. — A medical clinic is a permitted use on this site. However, architectural review/approval is <br />needed. I'm attaching a copy of the guidelines for this zoning district. <br />• Paragraph 3.h. — Unrestricted access will be via Viking Drive (east side of property). Ramsey County will not <br />allow access on Rice Street. <br />• Paragraph 5 — We are not interested in providing an ALTA survey for the site. It was recently platted and we <br />have provided a copy of that. ALTA surveys are typically a necessity of project financing and given the purchase <br />price of the property, we are not interested more out of pocket expenses. <br />• Paragraph 6—Same as last item. <br />• Paragraph 7c — We have identified the only environmental issue we are aware of on this site (Oasis Fuel Tank <br />Release). The site was "closed" by MPCA, but as you know, the redevelopment of the site could trigger some <br />remediation if the contaminated area is encountered. If you have review the reports I sent you, the <br />contamination was in a fairly confined area and is likely below the foundation area unless a basement is <br />planned. The contaminated area could be encountered if utility lines run through the area in question.
