Subject to compliance with the terms of this Agreement, the Owner shall be <br />permitted to operate storage, stockpiling, and processing (crushing) of aggregate materials and <br />other activities relating to the same for the purpose of making recycled concrete and asphalt <br />aggregate, as well as the storage, stockpiling and processing of topsoil (black dirt), as an interim <br />use in an I-2 District. <br />15. The site shall be improved and maintained per the approved Site Development Plan <br />on file with the City, which shall include but not be limited to the Owner paving the roadway <br />access area, paving and striping parking areas, installing and maintaining perimeter concrete <br />curbing around parking areas, limiting the usage of the west entrance onto Ryan Drive, limiting <br />the height of stockpiled materials, controlling dust, and providing adequate berming and <br />landscaping of the operation as approved by City staff. <br />16. Owner shall comply with the approved erosion control plan for the prevention of <br />damage to adjacent property and the control of surface water runoff. As the operation continues, <br />the City may impose additional erosion control requirements if, in the opinion of the City <br />Engineer, they would be useful. Owner shall comply with the erosion control plans. <br />17. Owner shall promptly clear any soil, earth or debris resulting from work by Owner <br />or of its customers, agents or assigns. Owner's responsibilities shall also include sweeping <br />public streets in the vicinity of the interim use operation to remove any debris tracked from the <br />site onto the public streets. Owner shall constantly monitor conditions and sweep as needed or <br />within 24 hours notice by City. <br />
