The park sits currently sits <br />on three parcels including one which has no street frontage. That parcel includes a <br />portion of the skating rink area and the warming house facility. The City needs to <br />update the warming house with accessible restrooms, which has raised two zoning <br />issues: <br />1. Zoning. It has been discovered that the land -locked parcel in question is <br />zoned R-1, although all of the property around it is zoned Public -Semi Public. <br />The City proposes to combine the parcel with the Old Fire Hall property along <br />Little Canada Road. This necessitates that the added parcel be rezoned to <br />the same Public -Semi Public district as the surrounding properties. <br />2. The warming house currently sits 9.98 feet from the east property line, where <br />a 15 foot side yard setback would be required. To permit the additional space <br />for accessible restrooms, the City proposes to shift the building slightly south. <br />However, it is not possible to move the building closer to the rink itself, and <br />St. Paul Water will not permit further encroachment into their right of way. As <br />such, the reconstructed building will need to shift about one foot closer to the <br />side property line, with a resulting setback of 8.93 feet at the closest <br />(northeast) corner. The southeast corner will be at 12.74 feet from the <br />property line. A variance is necessary to consider this setback <br />encroachment. <br />
