Hanson <br />MEMORANDUM <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Kathy Glanzer, City Clerk <br />DATE: August 28, 2014 <br />RE: Amend the Liquor Code Eliminating Available On -Sale Restaurant Liquor <br />License <br />As the Council is aware, the Municipal Code provides for the following On -Sale Liquor <br />Licenses: <br />Five On -Sale Liquor Licenses — all are taken; <br />Two On -Sale Restaurant Liquor License — one is taken. <br />With regard to the number of liquor licenses that Little Canada is allowed under Minn. Stat. <br />340A.413 Subd. 1 and Subd. 4, a city of our size is allowed six On -Sale Licenses and can issue <br />an unlimited number of On -Sale Restaurant Licenses (see State Statute attached). You may also <br />recall that in 1987, the City of Little Canada was authorized two additional On -Sale Licenses as <br />well. Therefore, the total of On -Sale Licenses authorized by State Statute would be eight plus an <br />additional unlimited number of On -Sale Restaurant Licenses. <br />It has been suggested that the Council consider the elimination of this available On -Sale <br />Restaurant Liquor License at this time. It should be noted that the Council is free to adjust the <br />number of liquor licenses up or down, as it sees fit, provided the maximums under State Statute <br />are not exceeded. If the available On -Sale Restaurant Liquor License is eliminated, the Council <br />can add any number of On -Sale Restaurant Liquor Licenses back into the Code at any time. <br />Staff has also discussed whether there is the need to review the minimum standards for the On - <br />Sale Restaurant License (see Code attached) These standards have not been reviewed since <br />2011, and the Council may want to review them for potential modification. One example is the <br />current "escalator" provision relative to initial investment in a restaurant. The current Code <br />requires a $1 million investment in the restaurant and states...."The required amount shall be <br />periodically adjusted upward or downward by amendment to this section to reflect changes in <br />construction costs utilizing the CPI". An option may be a more general statement that the $1 <br />million figure would be adjusted annually based on the CPI without annually amending the <br />1 <br />
