Hanson <br />MEMORANDUM <br />TO: Mayor Blcsener and Members of the City Council <br />FROM: Kathy Glanzer, City Clerk <br />DATE: September 18, 2014 <br />RE: Tobacco Licensing — General Tobacco Sales & Display License <br />The Council will recall its discussion at its September 10, 2014 meeting relative to an inquiry for <br />a General Tobacco Sales & Display License accessory to a restaurant use in the Market Place <br />Shopping Center. The owner of the shopping center inquired about the dedication of <br />approximately 250 square feet of space within Daubers Cafe for tobacco sales. This space would <br />be at the far back of the restaurant and near a back entrance/exit door (see diagram attached). <br />Based on that discussion, the City Attorney has revised his report providing for a definition of <br />General Sales and Display License addressing the following: <br />• Clarifies that tobacco sales under the General Sales & Display License tobacco <br />license must be accessory to the primary business purpose. <br />• Establishes a maximum display area in cubic feet. City staff asked the owner of <br />Gas N Go to measure the amount of tobacco display area in his convenience store. <br />Tom Vogt at Gas N Go calculated that he has 21 cubic feet of tobacco display <br />area, as well as a small cigarette lighter rack on the counter. Vogt felt that Gas N <br />Go has a little larger display area than the average gas station/convenience store. <br />For your information, the display area consists of racks behind the counter that the <br />clerk can reach up to and grab a package of cigarettes for a customer. City staff' <br />would recommend that the Council establish a maximum amount of display area <br />under the General Sales & Display License to help maintain significant <br />differences with the Tobacco Store License criteria. <br />• Requires that the tobacco display area be located with the immediate vicinity of <br />the establishment's primary point of sale. <br />o Prohibits an entrance door opening directly to the section of the store displaying <br />tobacco. <br />1 <br />
