Hanson <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Kathy Glanzer, City Clerk <br />DATE: September 18, 2014 <br />RE: Amendment to Liquor Code Relative to On -Sale Restaurant Licenses <br />At its September 10, 2014 meeting, the Council discussed the possibility of amending the City's <br />Liquor Ordinance relative to Minimum Standards for On -Sale Restaurant Liquor Licenses as <br />well as the number of On -Sale Restaurant Liquor Licenses provided for in the Code (see minutes <br />attached). <br />Based on that discussion, City staff has prepared an ordinance amendment which does the <br />following: <br />*Provides for an automatic annual adjustment of the initial investment necessary for an <br />On -Sale Restaurant Liquor License based on the Consumer Price hndex for All Urban <br />Consumers (CPI -U) as would apply in the Twin Cities area; <br />*Eliminates the reference in 703.030 (1) to the transfer of such liquor license as liquor <br />license transfers are prohibited by Ordinance Section 703.080 (2); <br />*Reduces the number of On -Sale Restaurant Liquor Licenses from two (2) to one (1) as <br />provided for in Section 703.110 (2) while adding language that identifies the number of <br />On -Sale Liquor and On -Sale Restaurant Liquor Licenses that would be allowed under <br />State Statute. This would put anyone on notice seeking a liquor license that they would <br />have the ability to request that the City amend its Code to increase the number of these <br />licenses up to the State Statute maximums. It should be noted that if the Council reduces <br />the On -Sale Restaurant Liquor License to one, the City will be at the maximum for both <br />On -Sale Liquor Licenses and On -Sale Restaurant Liquor Licenses. <br />*Eliminates Section 703.110 (b) which requires that there can be only one temporary <br />liquor licenses issues to any one organization or registered political committee, for any <br />one location, within any thirty -day period.
