MINUTES CITY COUNCIL OCTOBER 22, 2014 Montour introduced the following resolution and moved its adoption: RESOLUTION NO. 2014-10-198 — ADOPTING AN ORDINANCE AMENDING THE CABLE TELEVISION FRANCHISE EXTENDING THE FRANCHISE THROUGH DECEMBER 31, 2016 The foregoing resolution was duly seconded by Boss. Ayes (5). Nays (0). Resolution declared adopted. McGraw introduced the following resolution and moved its adoption: RESOLUTION NO. 2014-10-199 — ADOPTING A RESOLUTION CONDITIONALLY GRANTING THE CONSENT TO THE TRANSFER OF CONTROL OF THE CABLE TELEVISION FRANCHISE AND CABLE TELEVISION SYSTEM FROM COMCAST CORPORATION TO GREATLAND CONNECTIONS, INC. The foregoing resolution was duly seconded by Montour. Ayes (5). Nays (0). Resolution declared adopted. TOBACCO The City Clerk commented that the City has been approached by Kelly LICENSE - Ortiz indicating he would like to operate a convenience store on Rice 2526 RICE Street that would have tobacco sales. She noted the Council is currently STREET working to better define the General Tobacco Sales & Display License, clarifying that this license allows tobacco sales as an accessory use and limiting the amount of tobacco display area to somewhere between 20 and 30 cubic feet. The Clerk noted that Mr. Ortiz has indicated that the amount of cubic feet being considered would be too restrictive and he is interested in approximately 480 square feet of floor space for tobacco sales (approximately 40% of the total floor space of 1,200 square feet). The Clerk noted that the City Code also provides for a Tobacco Store License; however, the City has a limit of two Tobacco Store Licenses and none are available. Tom Duray, owner of 2526 Rice Street, appeared before the Council on behalf of Mr. Ortiz. Duray provided a detailed history of his ownership of the property. He noted that the building consists of 2,400 square feet, half occupied by Papa Murphy's and half currently vacant since February. Duray pointed out the empty store fronts along Rice Street.
