MINUTES <br />CITY COUNCIL <br />OCTOBER 22, 2014 <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-10-198 — ADOPTING AN ORDINANCE <br />AMENDING THE CABLE TELEVISION FRANCHISE EXTENDING <br />THE FRANCHISE THROUGH DECEMBER 31, 2016 <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-10-199 — ADOPTING A RESOLUTION <br />CONDITIONALLY GRANTING THE CONSENT TO THE <br />TRANSFER OF CONTROL OF THE CABLE TELEVISION <br />FRANCHISE AND CABLE TELEVISION SYSTEM FROM <br />COMCAST CORPORATION TO GREATLAND CONNECTIONS, <br />INC. <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />TOBACCO The City Clerk commented that the City has been approached by Kelly <br />LICENSE - Ortiz indicating he would like to operate a convenience store on Rice <br />2526 RICE Street that would have tobacco sales. She noted the Council is currently <br />STREET working to better define the General Tobacco Sales & Display License, <br />clarifying that this license allows tobacco sales as an accessory use and <br />limiting the amount of tobacco display area to somewhere between 20 and <br />30 cubic feet. The Clerk noted that Mr. Ortiz has indicated that the <br />amount of cubic feet being considered would be too restrictive and he is <br />interested in approximately 480 square feet of floor space for tobacco <br />sales (approximately 40% of the total floor space of 1,200 square feet). <br />The Clerk noted that the City Code also provides for a Tobacco Store <br />License; however, the City has a limit of two Tobacco Store Licenses and <br />none are available. <br />Tom Duray, owner of 2526 Rice Street, appeared before the Council on <br />behalf of Mr. Ortiz. Duray provided a detailed history of his ownership of <br />the property. He noted that the building consists of 2,400 square feet, half <br />occupied by Papa Murphy's and half currently vacant since February. <br />Duray pointed out the empty store fronts along Rice Street. Duray <br />reported that Ortiz has signed a three year lease for his space with a five <br />4 <br />
