MINUTES <br />CITY COUNCIL <br />OCTOBER 22, 2014 <br />CONSENT <br />AGENDA <br />need the amount of square footage dedicated to tobacco sales that Ortiz is <br />proposing. Blesener felt that 40% was not right figure, and asked if the <br />City would be able to restrict the sale of certain tobacco -related products. <br />Duray suggested that the City could restrict the sale of certain products <br />under its license as well as the amount of square feet that could be <br />dedicated to tobacco sales. The City Clerk suggested that the City <br />Attorney will need to provide an opinion on the City's ability to restrict <br />the sale of tobacco -related products. <br />Keis felt the proposal should be called what it is, a tobacco store that will <br />sell some convenience items. <br />McGraw noted that there could be staff time involved in policing the <br />business to ensure that conditions are being complied with. <br />Duray then reviewed a diagram of what the interior layout of the store <br />would look like. Montour noted that there appears to be three times the <br />space dedicated to tobacco sales versus convenience item sales. Montour <br />stated that this proposal was a tobacco store inside of a convenience store. <br />Pending receipt of additional information, this matter will be reviewed at <br />the November 12111 Council meeting. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-10-200 —APPROVING THE CONSENT <br />AGENDA WHICH CONTAINS THE FOLLOWING: <br />* 4PPROVAL OF THE VOUCHERS; <br />*AUTHORIZE ADVERTISEMENT OF PARKS & RECREATION <br />COMMISSION AND PLANNING COMMISSION VACANCIES; <br />*APPROVAL OF RAFFLE PERMIT FOR FISH HOUSE FRENZY <br />AT JOE'S SPORTING GOODS REQUESTED BY REBUILDING <br />TOGETHER TWIN CITIES; <br />*APPROVAL OF PURCHASE AGREEMENT FOR 3046 LABORE <br />ROAD AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />6 <br />
