specified by these zoning regulations for the district in which such land and buildings are <br />located. Any building which is damaged to an extent of less than fifty (50) percent of its <br />value may be restored to its former extent. Estimate of the extent of damage or <br />destruction shall be made by the Building Official. <br />State Statute specifies that the non -conforming use can only be reestablished if a building permit <br />has been applied for within 180 days. The fire occurred on October 3, 2014 so that 180 day <br />deadline will be April I, 2015. Russ wants to ensure he finds an effective solution to correct the <br />drainage problems he has experienced in the past. He believes he will be ready to apply for the <br />building permit by that April Is' deadline. However, staff will continue to work closely with him <br />to make sure things are progressing. If for some reason he would not be ready by April Is', staff <br />may bring this back to the Council for consideration of an extension of that180 days. This would <br />allow him the time to make sure this is properly corrected. <br />Two additional items that Russ has requested consideration of by the Council are to allow the <br />continuance of rental outdoor storage, as well as, the use of a 40 ft. storage pod on his property <br />until construction is completed. Both of these requests are things impacted by the loss of the <br />building due to the fire. <br />1) Russ has requested to continue to be allowed outdoor storage for a few trucks and trailers <br />for his business only. He has also requested to continue to be allowed rental outdoor <br />storage as his current IUP allows (the buses). Russ has indicated that only the storage <br />area to the east of the building will be used during this interim time. No outdoor storage <br />will occur anywhere else on the property due to the need for maneuverability of vehicles <br />and equipment during demolition and construction. <br />Note: Outdoor storage is an accessory use permitted by ordinance. The reason staff is <br />asking for Council review is because with the loss of the principal building and use, Russ <br />is requesting to be allowed to continue an accessory use without a principal building or <br />use. <br />2) Russ will need a 40 ft. storage pod that would be located in front of the fenced area (not <br />screened in the NE corner of the property). It will be used to house some of the items <br />salvaged from inside the building. Russ has indicated these are items from his business <br />space, not his tenants. The storage pod would be removed once constructed is completed. <br />City staff's recommendation is to approve both of the above requests. The rental outdoor <br />storage is not impacted by whether or not there is a building on the site. Additionally, the <br />storage pod will only be on the site temporarily. This was an unfortunate event and city <br />staff believes efforts should be made to try and work with the property owner to not <br />negatively impact him anymore than what has already occurred. Staff also recommends <br />that the storage pod approval be contingent on It being used to store contents from inside <br />the building. Additionally, that the storage pod is tied to the building permit being issued <br />and will be removed 30 days after the final inspection is completed. if the building permit is <br />not completed by the above deadline, the storage pod is required to be removed from the <br />site immediately. <br />Lastly, Nova Auto Sales one of the two auto related uses located at 200 Ryan Drive has requested <br />that no action be taken on their automotive repair or sales licenses. This property has two <br />indoor retail sales licenses, one salvage repair license, and one minor repair license. Russ <br />2 <br />
