Hanson <br />TO: General Tobacco Sales & Display License Holders <br />FROM: Kathy Glanzer, City Cleric <br />DATE: October 7, 2014 <br />RE: Amendment to Tobacco Ordinance related to General Tobacco Sales & <br />Display License Criteria <br />At its November 12, 2014 meeting, the City Council will be considering adoption of <br />amendments to the Tobacco Ordinance relative to criteria for General Tobacco Sales & Display <br />Licenses. Attached is a draft of the proposed ordinance changes. The highlights of these <br />changes are as follows: <br />• Clarifies that tobacco sales under the General Sales & Display License tobacco <br />license must be accessory to the primary business purpose, for example, a gas <br />station convenience store or a drug store that sells tobacco and tobacco projects. <br />• Establishes a maximum display area in cubic feet to help maintain significant <br />differences with the "Tobacco Store License criteria. A range of 20 to 25 cubic <br />feet of display area is being considered. Council has asked that license holders <br />provide an estimate of the amount of display area they currently have in cubic <br />feet. It is not the Council's intention to reduce what currently exists, but to ensure <br />that tobacco sales under this license are an accessory use. See survey form <br />attached. <br />• Requires that the tobacco display area be located with the immediate vicinity of <br />the establishment's primary point of sale. <br />• Prohibits an entrance door opening directly to the section of the store displaying <br />tobacco. <br />• Prohibits a separate point of sale for tobacco sales. <br />7 <br />
