1. Commencement Date. The commencement date of this Third Amendment is the first day of <br />the month following the start of construction related to this Third Amendment. <br />2. Renewal Term. Tenant shall have the right to extend this Agreement for four (4) additional <br />terms of sixty (60) months each on the same terms and conditions as set forth in the Agreement <br />(each a "Renewal Term"). Unless Tenant notifies Landlord (at the addresses set forth in the <br />Agreement) of its election not to exercise any Renewal Term at least 60 days prior to the <br />expiration of the Initial Term or the current Renewal Term, each Renewal Term shall <br />automatically be exercised without notice or other action of any kind by Tenant. <br />3. Equipment. Tenant shall modify the equipment on the water tower as set forth in the Exhibit <br />A attached hereto. Exhibit A shall replace any other description of Tenants equipment in the <br />Agreement. Such additional modifications and upgrades will take place within the existing <br />shelter, the size of which will not be expanded in any way. <br />4. Rent. Effective on the commencement date of this Third Amendment, the monthly rent shall <br />increase by Six Hundred and 00/100 ($600.00) per month. Additionally, Tenant will pay all costs <br />for the structural modifications to tower to support Tenant's proposed equipment listed in <br />Exhibit A of this Third Amendment, if any are needed. <br />5. Notices. Section 12 of the Agreement is hereby deleted in its entirety and replaced with the <br />following: <br />NOTICES. All notices, requests, and demands hereunder will be given by first class certified or <br />registered mail, return receipt requested, or by a nationally recognized overnight courier, postage <br />prepaid, to be effective when properly sent and received, refused or returned undelivered. <br />Notices will be addressed to the parties as follows. <br />If to Tenant: <br />New Cingular Wireless PCS, LLC <br />By: AT&T Mobility Corporation, <br />Attn: Network Real Estate Administration <br />Re: Cell Site #:MNL03034, Cell Site Name: Little Canada (MN) <br />FA No: 10081751 <br />575 Morosgo Drive NE <br />Atlanta, Georgia 30324 <br />With the required copy of legal notice sent to Tenant at the address above, a copy to the Legal <br />Department: New Cingular Wireless PCS, LLC <br />Attn: Legal Department, <br />Re: Cell Site #:MNL03034, Cell Site Name: Little Canada (MN) <br />FA No: 10081751 <br />208 S.
