SITE NAME: MINC Craig's List <br />SITE NUMBER: <br />LAND LEASE AGREEMENT <br />This Agreement, made this day of , 201_, between Little <br />Canada Economic Development Authority, a political subdivision under the laws of Minnesota, <br />with its principal offices located at 515 Little Canada Road East, Little Canada, Minnesota <br />55117, hereinafter designated LESSOR and Verizon Wireless (VAW) LLC d/b/a Verizon <br />Wireless, with its principal office located at One Verizon Way, Mail Stop 4AW100, Basking <br />Ridge, New Jersey 07920 (telephone number 866-862-4404), hereinafter designated LESSEE. <br />The LESSOR and LESSEE are at times collectively referred to hereinafter as the "Parties" or <br />individually as the "Party". <br />1. PREMISES. <br />a. LESSOR hereby leases to LESSEE a portion of that certain real property located <br />at 53 South Owasso Boulevard West, in the City of Little Canada, County of Ramsey, <br />State of Minnesota, as being further described in Exhibit "A" attached hereto and <br />made a part hereof (the entirety of LESSOR's property is referred to hereinafter as the <br />"Property"), being described as a nineteen feet 6 inches (19'6") by fifty-six feet (56') <br />parcel containing 1,092 square feet (the "Land Space"), together with the non- <br />exclusive right (the "Rights of Way") for ingress and egress, seven (7) days a week <br />twenty-four (24) hours a day, on foot or motor vehicle, including trucks and an utility <br />right of way for the installation and maintenance of utility wires, poles, cables, <br />conduits, and pipes over, under, or along the utility rights of way shown on Exhibit A <br />(hereinafter collectively referred to as the "Premises") being substantially as described <br />herein in Exhibit "A" attached hereto and made a part hereof. <br />b. LESSEE acknowledges that LESSOR, in its sole discretion, may redevelop the area <br />encompassing 53 South Owasso Boulevard in a manner that could result in a new <br />access point to South Owasso Boulevard; the construction of a new street/driveway to <br />serve the area; and the replatting of property. LESSOR will insure that LESSEE has a <br />continued and unimpeded right of access to the property and utilities, which serve the <br />property throughout the term of this lease. LESSOR shall pay for the costs of <br />constructing the improvements. LESSEE shall pay for the construction costs to <br />relocate its utilities including fiber. LESSOR shall give LESSEE at least 90 days <br />notice prior to requiring LESSEE to relocate its utilities. LESSEE's use of the <br />premise shall not he interrupted or diminished during the construction of the <br />improvements. LESSEE shall be allowed, at LESSEE's sole determination, to place a <br />temporary installation on the property during any such relocation. <br />2. SURVEY. LESSOR also hereby grants to LESSEE the right to survey the <br />Property and the Premises, and said survey shall then become Exhibit "B" which shall be <br />attached hereto and made a part hereof, and shall control in the event of boundary and access <br />discrepancies between it and Exhibit "A".
