Hanson • <br />Per Council discussion at the last meeting, I reviewed State Statute which states "The governing <br />body of a municipality may issue a temporary license of on -sale of intoxicating liquor in <br />connection with a social event within the municipality sponsored by the licensee". (See <br />attached.) Based on that language, I do not believe the Council could pass this authority on to a <br />staff member. <br />However, in looking at the Liquor Ordinance, I noted that the following code provisions: <br />(3) (a) No more than three four-day, four three-day, six two-day, or twelve one - <br />day temporary licenses, in any combination not to exceed twelve days per year may be issued for <br />the sale of intoxicating liquor to any one organization or registered political committee, or for <br />any one location, within a twelve-month period. <br />(b) No more than one temporary license may be issued for the sale of <br />intoxicating liquor to any one organization or registered political committee, or for any one <br />location, within any thirty -day period. <br />With regard to (3) (a), the City Code provision mirrored State Statute as it previously existed, but <br />the Statute has been since amended to say "The license may authorize the on -sale of intoxicating <br />liquor for not more than four consecutive days...". While the restriction on the number of <br />temporary liquor licenses in the City Code has not been a problem for the organizations that <br />typically request these licenses, I wanted to point this out to the Council. <br />With regard to (3) (b), the City has not followed this provision given the timing of many of the <br />St. John's Church events. Therefore, it would be staff's recommendation to eliminate this <br />restriction. There is nothing in State Statute that would require the restriction to stay in place. <br />It would be staff's recommendation the Chapter 703 of the City Code be amended to eliminated <br />Section 703.110. (3) (b). <br />
