Specific offices <br />It is important to remember that incompatibility often depends on the <br />nature of the offices and their relationship to one another. So, while offices <br />may have been determined to be incompatible in the past, a different <br />conclusion could be reached based on current relationships or <br />responsibilities. A city official who is considering seeking an additional <br />office should obtain a legal opinion from the city attorney on the <br />compatibility of the two offices. <br />1. Compatible offices <br />The following offices are compatible pursuant to state statute: <br />• City charter commission member and any elective or appointed office <br />other than judicial (however, the city charter may specifically exclude <br />councilmembers from serving on the charter commission). <br />• City councilmember and HRA commissioner. <br />• City councilmember and EDA commissioner. <br />• City attorney and county attorney (in counties with a population under <br />12,000). <br />In addition, the attorney general has found the following offices <br />compatible: <br />• City councilmember and county treasurer. <br />• City mayor and court administrator. <br />• City attorney and assistant county attorney. <br />• City councilmember and officer of nonprofit, public -access cable <br />service provider. <br />2.
