General Conditions <br />6.6 CONCEAI.EI) CONDITIONS <br />Should concealed or unknown conditions in an existing structure be at variance with the conditions <br />indicated by the Contract Documents or should concealed or unknown conditions in an existing <br />structure of an unusual nature, differing materially from Grose ordinarily encountered and generally <br />recognized as inherent in work of the character provided for in this Contract, be encountered, the <br />Contractor shall make any claim for adjustment in compensation in accordance with Paragraph 6.7. <br />6,7 CLAIMS FOR ADDI'T'IONAL COST'S <br />If the Contractor wishes to make a claim for an increase in the Contractor's Compensation, it shall <br />give the Owner written notice thereof within ten (10) days of the occurrence of the event -giving rise <br />to such claim. This notice shall be given by the Contractor before proceeding to execute the Work, <br />except in an emergency endangering life or properly in which case the Contractor shall proceed in <br />accordance with Paragraph 6.8. No such claim shall be valid unless so made. If the Owner and the <br />contractor cannot agree on the amount of the adjusttnent in the Contractor's Compensation, it shall <br />be referred to the Owner in accordance with Paragraph 1.8. Any change in the Contractor's <br />Compensation resulting from such claim shall be authorized by any Change Orders. <br />If'the Contractor claims that additional cost is involved because of, but not limited to, (1) any written <br />interpretation of the Owner, (2) any order by the Owner to stop the Work where the Contractor was <br />not at fault, (3) any written order for a minor change in the Work or (4) failure of payment by the <br />Owner, Contractor shall make such a claim as provided herein. <br />6.8 WORK DURING AN EMERGENCY <br />6.8.1 In any emergency affecting the safety of persons or property, the Contractor shall act to prevent <br />threatened damage, injury or loss. In all cases it shall, as soon as practicable, notify the Owner of the <br />emergency and it shall not wait for the instructions before proceeding to protect both life and <br />property. <br />6.8.2 Any additional compensation or extension of time claimed by the Contractor on account of said <br />emergency work shall be determined under Paragraph 6.7. <br />7. CHANGE OF CONTRACTOR'S COMPENSATION <br />7.1 CONTRACTOR'S COMPENSATION <br />The "Contractor's Compensation" constitutes the total compensation (subject to authorized <br />adjustments) payable to Contractor for performing the Work. All duties, responsibilities and <br />obligations assigned to or undertaken by Contractor shall be at ifs expense without change in the <br />Contractor's Compensation. <br />7.2 CHANGE IN CONTRACT PRICE <br />Any claim for an increase in the Contractor's Compensation shall be based on written notice <br />delivered to Owner within ten (10) days of the occurrence of the event -giving rise to the claim. <br />Notice of the amount of the claim with supporting data shall be delivered within forty-five days of <br />City of Little Canada, City Hall Audio/Video Project 22 <br />26 <br />
