MEMORANDUM <br />DATE: April 3, 2015 <br />TO: Joel Hanson <br />FROM: Martin Norder <br />RE: Amendments to Ord. 1101 <br />We are proposing to amend two section of Little Canada City Code: Section 1101.050 and <br />1101.170. Regarding Section 1101.050, we are proposing adding a Section (0). This section <br />will allow the City to grant an applicant a provisional license if (1) the applicant's dog license is <br />denied by the City under Paragraph A of section 1101.050 or (2) if an applicant who has been <br />issued a dog license has two convictions within 2 years for violations of City Code § 1101.010 et <br />.seq. or Minn. Stat. § 347 et seq. Adding Section (C) will give the City options when a dog <br />license is denied as well as making sure individuals who are currently licensed can have <br />restrictions placed on the license if they have convictions for dog related offenses. Currently, <br />Section 1101.050 does not provide any recourse when a dog license application is denied. The <br />provisional license will have requirements that the dog owner must follow and provide proof to <br />the City that they are in compliance. The dog owner may reapply for a standard dog License after <br />two years if he or she is still in compliance with the provisional license requirements and has not <br />been convicted for any new dog related offenses. The two year requirement is consistent with <br />the City's standard dog licenses which are issued for two years. Section (C) also provides for the <br />City to seize any provisionally licensed dog if the owner is not in compliance with the <br />provisional license requirements. <br />Regarding the amendments to Section 1101.170, we are proposing adding the language regarding <br />the seizure of dangerous dogs to include potentially dangerous dogs. Currently, the City can <br />only seize dangerous dogs if the owner is not in compliance with the dangerous dog restrictions <br />and regulations. There is no recourse for owners who are not in compliance with the potentially <br />dangerous dog restrictions and regulations. Minn. Stat. § 347.53 states that "any statutory or <br />home rule charter city, or any county, may regulate potentially dangerous and dangerous dogs." <br />Little Canada already has potentially dangerous dog restrictions and regulations but does not <br />have an enforcement provision. Adding the language of potentially dangerous dogs to Section <br />1101.170 will allow the City to enforce the potentially dangerous dog restrictions and <br />regulations. <br />1 <br />
