However, this <br />agreement was signed by Thomas McManus for Thomas Homes, Inc. Thomas <br />Homes, Inc. was the vendee under a Contract for Deed. Thomas Homes, Inc. was <br />never the title owner of the property and Mr. McManus did not have authority to <br />authorize such certification of expenses. The City's claim for the unpaid fees are <br />restricted to Thomas Homes' interest in the Contract for Deed. <br />The estate will not pay these expenses and request that the City absolve these fees <br />at the time of closing.
