authorized to sell tobacco, tobacco products, tobacco -related devices, and delivery <br />devices are following and complying with the requirements of this ordinance. <br />Compliance checks shall involve the use of minors as authorized by this ordinance. <br />Compliance checks shall also mean the use of minors who attempt to purchase <br />tobacco, tobacco products, tobacco -related devices, or delivery devices for <br />educational, research and training purposes as authorized by state and federal laws. <br />Compliance checks may also be conducted by other units of government for the <br />purpose of enforcing appropriate federal, state or local laws and regulations relating <br />to tobacco, tobacco products, tobacco -related devices, and delivery devices. <br />(h) "individually Packaged" means the practice of selling any tobacco, tobacco product <br />or delivery device wrapped individually for sale. Individually wrapped tobacco, <br />tobacco products and delivery devices shall include but not be limited to single <br />cigarette packs, single bags or cans of loose tobacco in any form, single cans or other <br />packaging of snuff or chewing tobacco, e -cigarettes, and vapor inhalers. Cartons or <br />other packaging containing more than a single pack or other container as described in <br />this definition shall not be considered individually packaged. <br />(i) <br />"Delivery Devices" means any product containing or delivering nicotine or lobelia <br />any other substance intended for human consumption that can be used to deliver <br />nicotine, lobelia or any other substance through inhalation of vapor or any other <br />product or byproduct by any means, or any part of such a product, that is not tobacco <br />as defined in this section. Delivery devices include, but are not limited to: e - <br />cigarettes, e-eigars, personal vaporizers, or any other product where it delivers a <br />substance into the human body through the inhalation of vapor or any other product <br />or byproduct. Delivery devices do not include any product that has been approved or <br />otherwise certified for legal sale by the United States Food and Drug Administration <br />for tobacco use cessation, harm reduction, or for other medical purposes, and is being <br />marketed and sold solely for that approved purpose. <br />(j) "Smoking" means inhaling or exhaling smoke from any lighted or heated cigar, <br />cigarette, pipe, or any other lighted or heated tobacco, plant, natural or synthetic <br />product. Smoking includes inhaling or exhaling vapor or any other product or <br />byproduct of a delivery device. Smoking also includes carrying a lighted or <br />heated cigar, cigarette, pipe, or any other lighted or heated tobacco or plant <br />product intended for inhalation. <br />802.020. LICENSE REQUIRED. No person shall, directly or indirectly, keep for retail sale, <br />sell at retail, keep for wholesale, sell at wholesale or otherwise dispose of Tobacco Products, <br />tobacco -related devices, or delivery devices unless licensed by the City of Little Canada. A Tobacco <br />Store license is available to a premises meeting the definition in Chapter 802.010 (e); a General Sales <br />and Display license is available to a premises meeting the definition in Chapter 802.010 (a).
