PCP <br />5-6-2015 <br />On August 1, 2010, Minnesota adopted the Tobacco Modernization and Compliance Act. This <br />act updated existing state laws to reflect new tobacco products. A model ordinance was created <br />by the Public Health Law Center and League of MN Cities to incorporate the new state law. <br />Adoption of this ordinance will ensure comprehensive enforcement of youth access to tobacco <br />laws. <br />The Tobacco Modernization and Compliance Act: <br />- Updates the definition of tobacco products to include new products that are dissolved, <br />absorbed, inhaled or ingested by any other means; and <br />- Prohibits the sale of unapproved nicotine devices to minors; and <br />- Requires a license for the sale of pipes and rolling papers; and <br />- Prohibits selling all tobacco products and devices in open displays. <br />The model ordinance includes all of these provisions as well as language that: <br />- Prohibits the sampling of tobacco; <br />- Requires licensing for the sale of unapproved nicotine delivery devices (e -cigarettes); <br />- Prohibits any sale of tobacco by vending machine; <br />- Prohibits any and all sales of loose (single serving aka "loosies") tobacco products. <br />Below is a brief overview of what has been done at the local level as of September 2014. <br />• 27 cities and two counties have updated their tobacco ordinances to reflect new <br />products as well as nicotine or lobelia delivery devices: <br />o Dakota County: Lilydale, Mendota Heights, South St. Paul, and West St. Paul <br />o Hennepin County: Bloomington and Golden Valley <br />o Ramsey County: Arden Hills, Falcon Heights, Little Canada, Maplewood, Mounds <br />View, North St. Paul, Roseville, Shoreview, St. Paul, Vadnais Heights, and White <br />Bear Township <br />o Washington County: Hugo, Oakdale, Oak Park Heights, Woodbury <br />o Greater MN: Alexandria, Faribault, Hermantown, Mankato, Moorhead, Northfield <br />o Counties: Washington, Rock <br />• 15 cities have updated their tobacco ordinances to reflect only new products, not <br />including nicotine or lobelia delivery devices: <br />o Anoka County: Coon Rapids <br />o Dakota County: Apple Valley, Eagan, Hastings, and Lakeville <br />o Hennepin County: Champlin, Minneapolis, and Minnetonka <br />o Ramsey County: St. Anthony <br />o Scott County: New Prague, Shakopee, and Savage <br />o Greater MN: Cambridge, North Mankato, and Redwood Falls <br />Association for Nonsmokers- MN www.ansrmn.org 651-646-3005 <br />
