VACATION/ <br />IMPROVEMENT <br />OF <br />UNIMPROVED <br />ROSE LANE <br />RIGHT-OF-WAY <br />MINUTES OF THE WORKSHOP MEETING <br />CITY COUNCIL <br />LITTLE CANADA, MINNESOTA <br />APRIL 22, 2015 <br />Pursuant to due call and notice thereof a workshop meeting of the City <br />Council of Little Canada, Minnesota was convened on the 22nd day of <br />April, 2015 in the Council Chambers of the City Center located at 515 <br />Little Canada Road in said City. <br />Mayor John Keis called the meeting to order at 6:00 p.m. and the <br />following members of the City Council were present at roll call: <br />CITY COUNCIL: Mayor <br />Council Member <br />Council Member <br />Council Member <br />Council Member <br />ALSO PRESENT: City Administrator <br />City Attorney <br />City Clerk <br />Mr. John Keis <br />Mr. Tom Fischer <br />Mr. Michael McGraw <br />Mr. Rick Montour <br />Mr. Christian Torkelson <br />Mr. Joel R. Hanson <br />Mr. Patrick Kelly <br />Ms. Kathy Glanzer <br />The City Administrator reported that the purpose of this evening's <br />workshop meeting is to discuss unimproved Rose Lane with the abutting <br />property owners. The Administrator indicated that a number of years ago <br />Sam Roberto indicated that he would like more use of this unimproved <br />right-of-way with the intentions of cleaning it up and enhancing his yard. <br />The Administrator indicated that Mr. Roberto has asked for the vacation of <br />unimproved Rose Lane which, if fully vacated, would result in the north <br />25 feet of the road right-of-way accruing to his property. <br />The Administrator reviewed the history of the Variance that was granted <br />to the Buche's so that they could develop their house at 298 Rose Lane <br />utilizing the unimproved street right-of-way for their driveway. The <br />Buche's were then responsible for the placement and maintenance of this <br />driveway on the right-of-way. In return, adjacent property owners were <br />asked to be respectful in using the area. The Administrator pointed out <br />that that Variance was granted given it was determined that it would be <br />highly unlikely that the road would ever be improved in that area given the <br />steep slope that exists and due to the fact that there is wetland in the area <br />and would preclude the development of any additional lots. The <br />Administrator reported that the City Engineer looked at this area recently <br />and agreed with that position. The City Engineer also indicated that to <br />build a street to City standards in this area would be cost prohibitive. The <br />Administrator also noted that in building a new street and assessing the <br />cost, the City has to prove benefits received equal to the amount of the <br />
