MINUTES <br />CITY COUNCIL <br />MAY 11, 2015 <br />Montour did acknowledge that the City has received no complaints about <br />the Hookah Hideout. <br />Fischer echoed Montour's comments. He pointed out that he was not on <br />the Council when the ordinance was amended relative to this issue, but he <br />looked through the City's records and determined that the intent was to <br />allow no growth in either of the current tobacco stores and to maintain the <br />status quo for those two businesses. Fischer stated that he did not support <br />expanding this type of business. He indicated that what Nelson is saying <br />is a need, he views as a want. Fischer felt there was a big distinction <br />between the two. <br />Keis agreed with the comments made by Montour and Fischer. He <br />pointed out that the City allowed the two tobacco stores to be <br />grandfathered in when the City banned indoor sampling/smoking. He felt <br />there was no good reason to step away from that decision and to add the <br />addition license. Keis also pointed out additional restrictive actions that <br />the City of Maplewood is considering relative to e -cigarettes, pricing on <br />cigars, etc. <br />The City Attorney recommended that the Council take separate action on <br />Nelson's two requests. He noted the information contained in the City <br />staff's report relative to those requests. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-5-83 — DENYING THE DAVID NELSON <br />REQUEST FOR A TEXT AMENDMENT TO THE TOBACCO <br />ORDINANCE FOR THE ADDITION OFA THIRD TOBACCO <br />STORE LICENSE BASED ON THE FINDINGS THAT ARE <br />OUTLINED IN THE MAY 6, 2015 STAFF REPORT WITH THE <br />NUMBER OF TOBACCO STORE LICENSES TO REMAIN AT TWO <br />AS CURRENTLY PROVIDED FOR IN THE TOBACCO ORDINANCE <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-5-84 — DENYING THE REQUEST OF <br />DAVID NELSON TO RELOCATE AND EXPAND THE HOOKAH <br />HIDEOUT TO ANOTHER LOCATION WITHIN THE STRIP MALL <br />BASED ON THE INFORMATION OUTLINED IN THE MAY 6, 2015 <br />9 <br />
