(4) When a new fence is constructed along a property <br />line abutting railroad property, any existing <br />parallel boundary line fence within 5 feet of the <br />proposed fence, including posts, shall be removed <br />before construction of a new fence can take <br />place. <br />(5) All fences in the rear yard of residential <br />property that abuts a railroad track shall be <br />constructed to a maximum height of twelve (12) <br />feet. Fences to be constructed on corner lots <br />shall be no greater than six and one half (6 <br />feet within 30 feet of any street right of way <br />line. <br />(6) On all lots, fences shall meet the required <br />setbacks as set forth in the zoning code. <br />(7) All fences constructed pursuant to the section <br />shall meet all other applicable regulations for <br />fences under Section 903.020.F. All Railroad <br />Screening Fences shall be constructed of a <br />maintenance free material, such as vinyl; brick; <br />or weather -resistant metal or wood. Other <br />materials shall be deemed acceptable. <br />(8) Landscaping required. A landscaping plan shall <br />be submitted to the Planning Commission and the <br />City Council for review and approval, with an <br />emphasis on minimizing the view of the fence from <br />abutting property. <br />Section 3. <br />This Ordinance shall take effect and be in full force from and <br />after its passage and publication. <br />John Keis, Mayor <br />
