MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2007 <br />clear cutting was a waste of natural resources. He asked what the City's <br />options were in this regard. <br />The City Planner suggested that the City can build this into an approval, <br />and City staff would monitor the development for compliance. <br />Blesener asked if there was anyone from the general public wishing to <br />comment on this matter. <br />Dave Himmelbach, 2970 LaBore Road, reported that in 1976 the City <br />Council approved a building permit for Bill Richie to conshuct a building <br />on his property line. In constructing this building, Mr. Richie excavated <br />into an embankment that extended into a neighboring property. He also <br />proceeded to dump debris onto the neighboring property for the next 20 <br />years. Himmelbach felt it was the City's responsibility to remove this <br />debris and clean up the area. Himmelbach reported that some of the debris <br />consists of branches and trees, which should be chipped and spread over <br />the embankment. <br />Keis asked if Mr. Himmelbach ever complained about this situation. <br />Himmelbach stated that it was not obvious to him until last year when the <br />Richie property was being surveyed. He noted that the survey shows that <br />the Richie garage is within 20 inches of his shared property line. <br />Himmelbach also stated that he would like soil testing done to determine <br />whether or not any hazardous materials have been dumped in this area. <br />With regard to the wetland delineation, Himmelbach noted that this <br />summer, the State was in a drought situation. Therefore, he questioned the <br />validity of the wetland delineation. Himmelbach noted that the new <br />delineation has reduced the amount of wetland area significantly. <br />Blesener pointed out that the wetland estimation done previously was <br />based on an aerial survey and not an actual field delineation. The City <br />Administrator replied that that was correct. He also noted that a drought <br />does not affect the outcome of a wetland delineation in terms of soil and <br />plant evaluations. <br />Himmelbach reported that there are very old trees on the property that <br />should be preserved. He also noted that 30 caliper inches could be one <br />tree. Himmelbach requested that the City work with the developer to save <br />as many trees as possible. This will improve the property's value and be <br />better for the area. Himmelbach also requested afour-way stop at the <br />intersection of Arcade Street and LaBore Road given the traffic the <br />development will add to LaBore Road. <br />10 <br />
