MINUTES <br />CITY COUNCIL <br />MARCH 26, 2007 <br />o THAT THE CITY COUNCIL DOES NOT FEEL AN <br />AMENDMENT TO THE EXISTING CUP WOULD BE <br />APPROPRIATE FROM A LAND USE STANDPOINT <br />o THE DENIAL OF OUTDOOR STORAGE BY THE <br />CITY COUNCIL IS A FORMALITY GIVEN THAT THE <br />APPLICANT HAS VERBALLY WITHDRAWN HIS <br />REQUEST FOR OUTDOOR STORAGE AT THE <br />PLANNING COMMISSIONMEETING OF MARCH 8, <br />2007. <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />PROPERTY Mayor Blesener opened the Public Hearing to consider the request for <br />DIVISION - property division of 69 and 75 Demont Avenue East into two single- <br />69 AND 75 family lots resulting in a zero lot line configuration. Blesener noted that <br />DEMONT the City Planner and the Planning Commission have recommended <br />AVENUE EAST - approval of the property division subject to compliance with the <br />JACK BELIN recommendations of the City Planner and the Building Official. <br />Jack Belin, property owner, reported that the duplex was originally built in <br />2002. He would like to now subdivide the property so that each unit can <br />be sold individually and owner-occupied rather than rental property. <br />Blesener noted the requirement that the common wall between the <br />individual units meet International Building Code requirements. Belin <br />reported that the common wall has been inspected and it does not meet <br />IBC requirements. Belin stated that he has hired an architectural engineer <br />to design the improvements necessary to the fire wall. Those <br />improvements are outlined in a March 13, 2007 letter to the Building <br />Official. The Building Official has reviewed the proposed improvements <br />and finds them to be acceptable. Belin estimated the cost at $10,000. <br />Keis asked if lot size standards would be met. The City Planner replied <br />that they are met for attached single-family housing. <br />Keis expressed concern with building maintenance once each dwelling <br />unit is sold, i.e. roof replacement, painting, landscaping and lawn care. <br />Keis noted that with an association there are agreements in place for <br />addressing this issue. Belin replied that some of these concerns can be <br />alleviated with deed restrictions, i.e. common building and roof color. <br />Belin noted that if there would be disputes between the unit owners <br />relative to these types of issues, the dispute would then go to arbitration. <br />
