MINUTES <br />CITY COUNCIL <br />NOVEMBER 28, 2007 <br />The City Administrator suggested a PUD Development Agreement which <br />requires financial security and states that once 11,000 feet of the building <br />are leased, the exterior improvements will be done. The Administrator <br />noted that without financial security the City would have little assurance <br />that the exterior improvements will be made. <br />Wagner indicated that there is an issue with the timeline for closing n this <br />property. Drywall Supply will be renting the property back until <br />September. Drywall Supply needs another building, and this will give <br />Carl Johnson time to get a new building approved and constructed. Jess <br />Graba needs to give notice to his current landlord by the end of January <br />with a specific date and time for vacating his current premises. Without <br />that notice, Graba is locked into a five year least at his current location. <br />Wagner also indicated that the former Knox building has looked the way it <br />does for some time, therefore, did not feel it should be a concern if it <br />continued to look that way for a little longer. <br />The City Administrator noted that with the redevelopment of the former <br />Knox property approximately four years ago, nothing was done to this <br />building. Additionally, there has been a lack of maintenance on the <br />building. The Administrator stated that under the Development Stage <br />PUD Permit under consideration this evening, the Cityrs asking for <br />commitments relative to the upgrade of the exterior of the building as well <br />as a demonstration of the applicant's ability to perform. The <br />Administrator felt that without any guarantees, the City would just <br />continue to spin its wheels. Without those guarantees, the City <br />Administrator stated that he could not recommend approval of the <br />Development Stage PUD Permit. <br />Wagner noted that they are not Carl Johnson and should not be held <br />accountable for something that he has not done. Wagner stated that they <br />will do what they say they will do. <br />The City Administrator pointed out that the City has a Development <br />Agreement on this property, and the proposal is for an amendment to that <br />Development Agreement. Under Graba's request, he would assume <br />responsibility for the current Development Agreement and any <br />amendments. <br />Wagner again stated that the building has existed in its current condition <br />for a long time. He stated that the City has not had anyone else express <br />interest in the building, and noted that they are willing to make $1.5 <br />million in improvements. Wagner stated that he did not want to be held <br />responsible for someone else's lack of follow through. Wagner again <br />12 <br />
