MINUTES <br />CITY COUNCIL <br />JUNE 27, 2007 <br />McDONALD'S The City Administrator reported that as part of the Viking Drive <br />REAL ESTATE re-alignment project, the Oasis station is being demolished and a <br />SWAP portion of the Oasis property is being swapped with McDonald's in <br />AGREEMENT exchange for right-of--way to connect Viking Drive to Minnesota Avenue. <br />McDonald's will be taking the portion of the Oasis property on which the <br />car wash currently sits. There is some concern about contamination <br />relative to the waste pit in the car wash, and McDonald's is asking for an <br />addendum to the Swap Agreement holding them harmless from <br />responsibility for contamination from this waste pit. The City <br />Administrator reported that the exposure should be minimal given that the <br />waste pit should be self contained. The pit was pumped yesterday, and it <br />appears that it was intact. <br />The City Administrator recommended approval of the Addendum to the <br />Swap Agreement. He reported that the Oasis and two Viking Drive <br />structures will be demolished soon, and construction on the Viking Drive <br />re-alignment is scheduled to begin on July 9`~'. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-6-152 -APPROVAL OF THE <br />AMENDMENT TO REAL ESTATE SWAP AGREEMENT WITH <br />MCDONALD'S AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE THE AGREEMENT ON BEHALF <br />OF THE CITY <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />CONVEYANCE The City Administrator reported that the Oasis and Viking Drive <br />OF PROPERTY properties will be replatted. However, until that occurs and in order to <br />TO McDONALD'S move forward with the property swap with McDonald's, it is proposed <br />BY MEETS that the portion of Oasis property to McDonald's be conveyed by metes <br />AND BOUNDS and bounds description. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2007-6-I53 -CONVEYING PROPERTY TO <br />McDONALD'S BYMETES AND BOUNDS DESCRIPTIONAS <br />RECOMMENDED BY THE CITYADMINISTRATOR <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0).
