MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 8, 2007 <br />Sinclair Station. Hall felt that most traffic to the gas station was local in <br />nature. <br />Dehn pointed out that he has only owned the station for 1 %2 months. He <br />indicated that the station is visible for traffic coming from the north on 35E. <br />Hall asked if the second pylon will have to be removed if the Variance is <br />not granted. The City Planner again explained that bringing the non- <br />conforming signage closer to compliance with the Code would allow both <br />pylons to remain without the need for a Variance. The Planner suggested <br />that in acting on the Conditional Use Permit for Sinclair, the Commission <br />tie the signage into that approval and outline expectations for that signage. <br />The second pylon can exist as anon-conforming structure without the need <br />for a Variance. <br />Barraclough asked about the proposed B-4 Zoning. The City Planner <br />pointed out that this is the City's Comprehensive Business District which <br />allows a variety of business uses. <br />Marilyn Montreux questioned the ability to redevelop a gas station site. <br />The City Planner reported that it is possible to redevelop gas station sites <br />with other uses, but noted that tank removal, environmental testing etc. <br />would be required. <br />There was no one else present wishing to comment on this matter. <br />Duray recommended denial of the Variance to allow signage exceeding the <br />total square footage as well as the maximum number of signs allowed by <br />the Zoning Code as requested by Dehn Diversified Development for the <br />Sinclair Station at 228 Little Canada Road given there is no hardship <br />present that would warrant the granting of a Variance. <br />Motion seconded by Barraclough. <br />Motion carried 5 - 0. <br />Duray recommended approval of the Rezoning of the Sinclair Station at 228 <br />Little Canada Road from General Business (B-3) to Comprehensive <br />Business District (B-4) based on the finding that the proposed land use <br />designation is consistent with the character of the surrounding area and the <br />intent of the Comprehensive Plan. <br />Motion seconded by Barraclough. <br />Motion carried 5 - 0. <br />-5- <br />
