MINUTES <br />PLANNING COMMISSION <br />APRIL 12, 2007 <br />The Administrator reported that in December and January inspections of the <br />property occurred and there were still approximately 150 vehicles on site. <br />A search warrant was executed for this property and abuilding/fire <br />inspection identified imminent hazards which resulted in a red tag being <br />issued. The Administrator reported that Valor Enterprises has removed the <br />imminent hazards, but there are still over 100 electrical and building code <br />violations in existence. In recent inspections of the property, there is <br />evidence of people on the site. One gentleman was hooking up a towing <br />trailer. Neighboring property owners have reported numerous people on <br />site almost daily. The Administrator indicated that it appears that people <br />are working on the site even though Valor Enterprises has no licenses. The <br />Administrator noted that Valor Enterprises has continued to have a <br />disregard for the current state of affairs. <br />The Administrator reported that law enforcement has reported to the City <br />that on one occasion a VIN number tab from a stolen vehicle was found in <br />Mr. Fred Sedeghat's, Valor Enterprises, pocket. That stolen vehicle was <br />subsequently recovered on the Valor property. <br />The Administrator reported that Mr. Sedeghat's attorney, Michael Mergens, <br />indicated that the property issues will likely be resolved through the <br />subsequent sale of the property. <br />The Administrator pointed out that the Code allows the City to consider <br />public safety and public welfare in considering applications for Conditional <br />Use Permits. Given the extra ordinary amount of staff time that the Valor <br />Enterprises property has consumed, and the past history of this property, the <br />Administrator indicated that he had serious reservations that the situation <br />will ever change. The Administrator recommended extreme caution in <br />proceeding with the re-issuance of the Conditional Use Permits for Valor <br />Enterprises. <br />Duray pointed out the City's efforts in trying to clean up Ryan Industrial <br />Park and the many hours of meetings and code enforcement efforts directed <br />toward this goal. Duray noted that the City has had all the business owners <br />into discuss the condition of the park in general as well as the specifics of <br />each property. A lot of time has been directed toward this effort by the City <br />Council, Planning Commission, and City staff. Duray indicated that his <br />knowledge is that property owners have complied, except for Valor <br />Enterprises. Compliance has been an on-going battle with Valor <br />Enterprises. Duray indicated that the Council has appointed the Planning <br />Commission to consider the information presented and to make a <br />reasonable recommendation based on that information. Duray stated that he <br />had a real concern with re-issuance of the CUP's and increasing the number <br />of retail motor vehicle sales licenses. <br />-18- <br />
