1901. REGULATION OF PRIVATELY OWNED SWIMMING POOLS <br />1901.010. SWIMMING POOL DEEMED TO BE A STRUCTURE. A swimming pool, as <br />hereinafter defined, is deemed to be a structure and subject, therefore, to regulation and control <br />under the Zoning and Building Codes of the City of Little Canada. <br />1901.020. DEFINITIONS. For the purposes of this Ordinance, a swimming pool is defined <br />as a privately owned, outdoor pool, either above -ground or in -ground on private property, having the <br />capacity of over 1,000 gallons of water of 1-1/2 feet of water depth and intended to be used for <br />swimming or bathing purposes. <br />1901.030. BUILDING PERMIT REQUIRED. A building permit shall be required for the <br />construction, installation, enlargement or major alteration of any swimming pool as defined in <br />Section 1901.020. No new pool or altered existing pool shall be filled or used until it shall have <br />conformed to the provisions of this Ordinance. <br />1901.040. APPLICATIONS. The application for a building permit to construct, erect or <br />install a swimming pool shall be accompanied by plans of sufficient detail to show the proposed <br />location, size and dimensions of the pool, and the location of all structures on the same lot. In <br />addition, the plans shall show the proposed sereenin.g or landscaping as well as the location of all <br />equipment to be installed in connection with the operation of the pool such as pumps, filters and <br />heaters and the location of all existing and proposed utility lines. <br />1901.050. LOCATION. Swimming pools shall be located on single or double family <br />premises so that the outside perimeter, including all accessories, shall not be closer than ten (10) feet <br />to any side or rear lot line and no pool shall be located beneath or within ten (10) feet of any <br />overhead utility lines or over any underground utility lines. Pools shall not be located within any <br />utility, drainage or walkway easement, public or private. Pools on multi -family premises, such as <br />apartment dwellings, shall not be located closer than fifty (50) feet to any side or rear lot line. <br />1901.060. SCREENING. Screening consisting of the fencing or landscaping, or both,. shall <br />be situated between the pool structure and adjacent dwellings. <br />1901.070. SAFETY FENCING. <br />(A) All in -ground pools shall be completely enclosed by a fence at least four (4) feet high. <br />of the type and design to prevent children from gaining uncontrolled access to the pool. All fence <br />openings or points of entry shall be equipped with gates having self-closing and self -latching devices <br />high enough to be out of reach of small children. <br />(B) All above -ground pools shall be so designed and constructed that access to the pool <br />can only be had by means of a ladder, All such ladders shall be detachable and removed to an <br />inaccessible storage area when the pool is not in use by the owners thereof. While such ladders are <br />in use they shall be so placed that no child can. climb them without the owner's knowledge or <br />1901-1 <br />
