Park Availability Charges ................................................................................................. 1-3 <br />2101. PARK AVAILABILITY CHARGES <br />2101.010. PURPOSE. This Ordinance is enacted to provide for orderly, economic and safe <br />development of land and urban services and facilities, and to protect and promote the public health, <br />safety and general welfare of the inhabitants of the City of Little Canada., <br />^~~ <br />2101.020. LAND DEDICATION FOR PUBLIC USE. _ In all subdivisions, as defined by <br />Minnesota Statutes 1980, Section 462.352, for residential, commercial, industrial or other uses or <br />as a planned unit development which includes residential, commercial and industrial uses, or any <br />combination thereof, where the City Council deems it appropriate, a reasonable portion of each <br />proposed development shall be dedicated to the public for public use as parks, playgrounds, public <br />open space or storm water holding pond areas, or, at the option of the City, the person or firm <br />proposing the development shall donate to the City an amount in cash in lieu of land. The City <br />Council in determining the reasonable portion to be dedicated to the public may take into <br />consideration the open space, park, recreation or common areas and facilities which the developer <br />has provided for the exclusive use of the residents of the development. The portion of the total area <br />which becomes dedicated pursuant to these provisions shall be in addition to that land dedicated for <br />streets, alleys, easements and other public ways. No areas may be so dedicated for public use <br />without first having been approved by the City Council as suitable for the public purposes enunciated <br />in Section 2101.010 herein. <br />1. If the City Council, at its option, requires the developer to dedicate land, a maximum <br />of 10% of the total area to be subdivided shall be dedicated for public use as parks, playgrounds, <br />open space or storm water holding pond areas. <br />2. If the City Council, at its option, requires the developer to donate cash in lieu of <br />land, the following criteria shall be applied: <br />(a) The developer of any land to be developed as a residential subdivision <br />shall pay to the City a fee as set forth by City Council resolution. <br />(b) The developer of any land which is presently zoned for single family <br />dwellings and already has one or more single family dwellings situated <br />thereon, shall receive a credit or credits for the existing dwellings by <br />2101-1 <br />
