CITY COUNCIL <br />AGENDA ITEM <br /> <br /> <br />STAFF ORIGINATOR: Michael Grochala, Community Development Director <br /> <br />MEETING DATE: May 2, 2016 <br /> <br />TOPIC: Consideration to Approve Special Assessment Escrow <br />Agreement, 550 Lilac Street <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council approval of a Special Assessment Escrow Agreement. <br /> <br />BACKGROUND <br /> <br />Mr. Morteza Salehi, owner of the Apollo Business Center located at 550 Lilac Street, appeared <br />before the City Council on April 25, 2016. Mr. Salehi requested council consideration to abate <br />a delinquent utility charge that was levied against his property as a special assessment. The <br />City Council requested that the item be placed on the May 2, 2016 work session agenda for <br />discussion. <br /> <br />Due to the outstanding assessment issue the liquor license for Fiesta Cancun has not been <br />issued. The attached escrow agreement allows for Mr. Salehi to escrow the amount of <br />$8,865.13 with the City until the appeal process, either through judicial order or by mutual <br />agreement, is resolved. This in turn will allow the City to release the liquor license for the <br />restaurant. <br /> <br />Mr. Salehi has executed the agreement and deposited the escrow with the City. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of the Special Assessment Agreement. <br /> <br />ATTACHMENTS <br /> <br />1.
