<br /> <br /> <br />At the May 2, 2016 work session the City Council directed staff to seek a postponement <br />of the hearing and contact Metropolitan Council Environmental Services (MCES) <br />regarding possible redetermination of the SAC charges on the property. <br /> <br />The court hearing was rescheduled for June 21, 2016. <br /> <br />Staff contacted MCES regarding possible options regarding the SAC units for the site. <br />We have been informed us that they are unable to provide a credit based on the following <br />factors: 1) nothing has changed with the tenant space to warrant a redetermination, and <br />2) changes in SAC determination criteria are not retroactive. <br /> <br />It is possible that adjustments could be made with future tenant changes however, we are <br />not certain when and what those adjustments might be. <br /> <br />Mr. Salehi is still requesting Council consideration to abate the charges. <br /> <br />Requested Council Direction <br /> <br />Staff is requesting Council direction to place the abatement of the Special Assessment on <br />the June 13, 2016 agenda for consideration. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
