CITY OF LINO LAKES <br />RESOLUTION NO. 16-64 <br />RESOLUTION APPROVING THE PUD FINAL PLAN/FINAL PLAT <br />FOR NORTHPOINTE 4Tn ADDITION <br />WHEREAS, the City received an application for PUD Final Plan/Final Plat approval for <br />NorthPointe 4th Addition hereafter referred to as "Development"; and <br />WHEREAS, City staff completed review of the proposed "Development" based on the <br />NorthPointe 4th Addition Sanitary Sewer, Watermain, Storm Sewer and Street <br />Construction Plans dated May 12, 2016 and final plat received on June 23, 2016 and <br />prepared by Carlson McCain; and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on <br />December 11, 2013 and continued to the February 12, 2014 meeting and the Board <br />recommended approval of the PUD Development Stage Plan/Preliminary Plat; and <br />WHEREAS, the City Council approved the rezoning from R, Rural to PUD, Planned <br />Unit Development with Ordinance No. 02-14 and the PUD Development Stage <br />Plan/Preliminary Plat with Resolution No. 14-21; and <br />WHEREAS, Planning & Zoning Board reviewed and recommended approval of <br />NorthPointe 4th Addition PUD Final Plan/Final Plat on June 8, 2016; and <br />WHEREAS, the proposed development is not considered premature and meets the <br />performance standards of the subdivision and zoning ordinance; and <br />WHEREAS, the PUD Final Plan/Final Plat substantially conforms to the PUD <br />Development Stage Plan/Preliminary Plat. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino <br />Lakes hereby approves the PUD Final Plan/Final Plat for NorthPointe 4th Addition, <br />subject to the following conditions: <br />1. All comments from City Engineer letter dated June 2, 2016 shall be addressed. <br />2. The Development Agreement shall be executed by the City and the developer and <br />recorded by the developer. <br />3. The developer shall draft the deed for Outlot D, NorthPointe 4th Addition to the <br />City for parkland dedication. <br />4. The Phasing Plan shall be revised to reflect changes from the original plan. <br />5. A FEMA Letter of Map Revision shall be required by the City prior to any <br />building permits being issued on lots affected by the floodplain. <br />6. No permanent enclosed structures will be allowed in the park pursuant with the <br />City's Floodplain Management Ordinance <br />7. Title Commitment: <br />
