1 <br /> <br /> <br />CITY OF LINO LAKES <br />RESOLUTION NO. 16-50 <br /> <br />APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR WATERMARK A <br />DEVELOPMENT LOCATED IN THE NORTHWEST QUADRANT OF <br />I-35E AND CSAH 14/MAIN STREET <br /> <br /> <br />WHEREAS, Mattamy Minneapolis, LLC has requested a land use guide plan amendment to <br />change the northwestern 10 acres of the Watermark development from Urban Reserve to Mixed <br />Use; and <br /> <br />WHEREAS, Mattamy Minneapolis, LLC has also requested a change to the Utility Stage Plan <br />Map Amendment to bring the northwestern 10 acres from Stage 3 (post 2030 service area) to the <br />Stage 1B service area; and <br /> <br />WHEREAS, the 10 acre parcel is depicted on Exhibit A attached herein and legally described as <br />follows: <br /> <br />The North 330 feet of the South 3/4 of the Southwest 1/4 of the Southwest 1/4 of Section <br />12, Township 31, Range 22, Anoka County, Minnesota; and <br /> <br /> WHEREAS, the Planning and Zoning Board has reviewed the requested amendments at duly <br />called Public Hearings on April 13, 2016 and May 11, 2016 and recommends approval. <br /> <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />makes the following findings of fact based on the criteria outlined on page 3-26 of the 2030 <br />Comprehensive Plan: <br /> <br />FINDINGS OF FACT <br /> <br />a. The proposed development must be located within both the current and the next ten year <br />staging area, or five-year phase, or located adjacent to the current staging area. <br /> <br />The majority of the 372 acre development is classified as Mixed Use and is in either the Stage 1A <br />or 1B planned service area. The requested amendment is simply to incorporate the northwestern <br />10 acres into the project by reclassifying it as Mixed Use in the Stage 1B service area like the <br />other adjacent land in the Watermark project. Adding this site to the project is consistent with <br />the purpose of the Mixed Use classification, which is intended “to accommodate a mix of <br />residential, retail, and office uses either within one building, structure or development. <br />Residential development may include higher density housing options.” <br /> <br />b. The proposed development must be master planned. Small, piecemeal developments do <br />not justify redefining the ten-year staging area, or five-year phase. <br />
